THE FATE OF LAWS BANNING CONTENT MODERATION IS BEING DECIDED Florida and Texas both passed laws prohibiting internet platforms from censoring viewpoints they disagreed with and now the cases have been heard by the Supreme Court. Though opinions in NetChoice, LLC v Paxton and Moody v NetChoice, LLC have not been rendered, we're talking to Andy Jung who works as an Associate Counsel at TechFreedom, focused on technology law and policy such as antitrust, Section 230, and online privacy. He's written about both of these issues and after reading his work I've changed my mind about Section 230 and the protections it affords internet platforms. He makes the case here that moderating content is an editorial decision allowed under the First Amendment and it's very compelling. He joins me at 2:30 to discuss.

IT'S SUPER TUESDAY, Y'ALL And by the end of the day I fully expect Nikki Haley to be totally and utterly done in this primary, which I realize thrills those of you who now hate a Reagan style Republican. Don't forget to drop off your ballot today (and if you mail it today it will not count) and if you are an independent feel free to vote "Uncommitted Delegate" in the Dem primary just to mess with the Biden campaign. Just a thought.

THE COLORADO SUPREME COURT IS A HYPER POLITICAL EMBARRASSMENT As they've been overturned...again, by the US Supreme Court, this time keeping Donald Trump on the Colorado ballot. I tried to Google "Colorado Supreme Court upheld by the US Supreme Court" to see if our "Supreme Court" had gotten anything right in the last 20 years but nothing popped up so I can only assume that they just keep getting their rulings tossed for being so bad. This editorial has more, but our Left Wing Justices seem to be blinded by politics and our only option is to vote them all out so Jared Polis can replace them, and I think we all know how that would go. We're screwed.

WHY WE MUST HAVE A FUNCTIONING REPUBLICAN PARTY Another bill that would have helped keep illegal immigrant criminals in jail or be deported has been killed by Democrats. Read this from yesterday's editorial:

The day cops say an illegal immigrant disfigured and killed young college student Laken Riley is the day radicalized Democrats killed a bill written to help prevent such crimes in Colorado. The so-called “kill committee” — State, Veterans, & Military Affairs — favored tying the hands of law enforcement and easing the ability of foreign criminals to come here and remain illegally.
Do not be shocked. This is the same committee — under the same leadership within the same month — that gleefully rejected a proposal to increase penalties for adult rapists who prey on minors trafficked to meet their perverse demands.
Absolute power corrupts. Controlling the governor’s office and all other statewide offices, both U.S. Senate seats, the state House and Senate, and 6 of nine U.S. House districts, Democrats have absolute power checked by nothing. With it, they abuse the public — including vulnerable children increasingly traded in Colorado by cartels and other trafficking rings for the pleasure of local deviants.

This is why we have to take the party back, so we can stop some of the criminal coddling at the Capitol. Because they sure can't get it done with David Williams in leadership.

AN ALTERNATIVE THEORY FOR GLOBAL WARMING I often get asked by Warmies committed to the "it's our fault" school of climate change why there aren't other explanations for our current warming. I always tell them they are, but unless you tow the government line you can't get funding for research to prove or disprove them. The science around climate has been so distorted by government money that we are ignoring other theories that actually work BETTER than the carbon theory. Now we have the 2022 Nobel Prize winning physicist coming forward with the statement that there is NO climate "emergency" and presenting another theory for what's going on, which he does in this thread:

Of course he's been dragged by the Warmies for daring to say they are wrong. There is a LOT of money involved here, so any heretic who says anything that will stop the gravy train must be shouted down. Watch this interview for more on his alternate theory, and yes, he's kind of smart and even if you don't agree with him you must ask yourself why the IPCC report didn't talk about clouds? They seem to be very important here.

HELPING ADDICTS BY HELPING THEIR PETS This is a great story about an organization that finds foster families for the pets of addicts seeking treatment. This allows addicts, who may be reluctant to give up their animals to go into treatment, the chance to get clean knowing their pets are well cared for. I just love this.

DEMOCRATS LOVE TO GO AFTER GUNS BUT NOT-SO-MUCH FENTANYL Did you know that fentanyl killed 910 people between the ages of 18 and 45 in 2022? A whopping 206 in that same age range died via firearm the same year. ONE THIRD the number of fentanyl deaths. We already know that the Democrats running this state love to figure out new ways to make it harder to legally own a gun, but they don't seem to care as much about the people dying from fentanyl. There is a new bill being run by a Republican that would up the penalties for someone caught with fentanyl and I fully expect the Democrats to kill it. Read it here.

WE ARE HEADED BACK TO TENT CITIES IN DENVER As illegal immigrants who came here for free housing and tickets to somewhere else are being booted out of the migrant shelters they are heading to encampments popping up in places like the one near Elitch Gardens. Homeless people who used to live in RVs are now living in tents again after a city crackdown on the broken down vehicles that created a nuisance in neighborhoods. This is not going to end well. We'll see how well the Mayor's campaign promise goes shortly.

UNAFFILIATEDS ARE VOTING IN THE GOP PRIMARY Way more than they are voting in the Dem primary, which makes sense as the Dem primary is a formality. We'll see if enough of them vote for Nikki Haley to put her over the top but I'd be shocked if that happens. And to be clear, it would be a vote AGAINST Trump and not FOR Nikki Haley in my view so we can draw nothing from this for the General Election in November.

WE SHOULD CALL THIS THE ERIC GARNER BILL You remember the man in NYC who was killed in an altercation with cops over him selling "loosies", which is one cigarette, don't you? Colorado is poised to do the same thing New York did, which is create a market for black market cigarettes. It's their latest so-called "local control" bill which would allow cities to ban the sale of cigarettes and tobacco products, and this column makes the case that all this will do is create a black market. Maybe someone can get killed here too!

STANDARDIZED TESTING FOR COLLEGE MAY OR MAY NOT BE WORTH IT As colleges and universities work to get more diversity on campus they have been doing away with or lessening the impact of standardized testing like the ACT or SAT in admissions. In some cases, this is fine, especially for less rigorous or selective schools, but for more selective and rigorous schools they may be setting students up for failure. This story makes the point that each university needs to examine if students are successful without standardized testing and respond accordingly and it's exactly right. If state schools see students succeeding without SAT scores then it makes no sense to ask for them, while MIT might find that student success is more closely tied to those high scores. This is not a one size fits all situation.

HOW THE OVERTURN OF ROE V WADE EXPOSED HOW PRO CHOICE REPUBLICANS ARE This is a great story about Republicans having to come to terms with what happens when Roe V Wade allowed states to outlaw abortion, and it isn't going quite how staunch pro-lifers thought it would. In the deep red states that outlawed abortion outright there is a growing backlash coming not from Democrat voters, but from Republican voters. From the story:

Nearly 40 percent of Republicans support abortion in all or most circumstances. In the cases where the child is likely to be born with a life-threatening illness, 63 percent of Republicans believe a woman should be able to terminate her pregnancy. And when a victim of rape or incest seeks an abortion, the number of Republicans in favor rises to 76 percent. 

This is not good news for Republicans who will have this issue hung around their necks whether they want to talk about it or not. They will also face backlash from the pro-life wing of the party if they dare to say they support allowing a woman to make her own choice. It's a sticky wicket that can only occur when the dog catches the car. And the GOP is standing there with the car in its mouth.

WHY DO BRANDS KEEP PARTNERING WITH WEIRDO TRANS PEOPLE? To be clear, not all trans people are weirdos but the ones brand keep partnering with seem to be. Case in point, Doritos in Spain is not partnering with a trans person who has openly supported raping children. But I'm sure it will be fine.
